The Hon. NICK XENOPHON: I have been contacted by Neil and Elizabeth Hudson, a South Australian couple who were telephoned by telemarketers in mid-2004 on behalf of Nova Investment Solutions Pty Ltd, a company whose head office is based in Brisbane, Queensland. After expressing interest in the investment scheme operated by the company, Mr and Mrs Hudson received a glossy brochure referring to the massive returns of the `Logic 200 System' with a number of benefits including `proven figures'.

The scheme is, in fact, a horse racing tipping service based on a software program. The brochure goes on to state, `If you want to gamble, this is definitely not for you.' It also boldly states, `If instructions are followed, the rewards are there for the taking.' The Hudsons were also told that they were specially selected for this program and there were only two vacancies left to join the program nationally. As a result of representations both orally and in writing and a guarantee given by a company representative about the income they would receive from such a scheme, namely, that they would earn a $10 000 profit over eight months, the Hudsons parted with $3 000, their long saved for holiday money, as a downpayment on the program. After eight months in the scheme, not only did the Hudsons fail to earn the promised $10 000 but the $3 000 they invested was, in effect, worth­less.

The Hudsons have been referred by OCBA in South Australia to the equivalent Queensland office, notwithstand­ing independent legal advice I have received from a commer­cial law barrister that the representations were made in South Australia as they were received and acted upon here. The Office of Consumer and Business Affairs web site provides a list of examples of such schemes, labelling them `scams' but does not indicate what if any action has been taken against scam operators or any action to ban such schemes. My questions are:

1. What steps have been taken to clamp down on such schemes, given the warnings on the OCBA web site?

2. Why is there no warning on the OCBA web site about the company in question?

3. How many complaints has OCBA received in the past three years about these schemes and what, in general terms, were the steps taken?

4. Does the minister concede that OCBA has the jurisdic­tion to deal with such matters on behalf of South Australians stung by such schemes and would it be more appropriate for OCBA to take up the fight for South Australians ripped off by such schemes rather than referring them off to an interstate office?

5. Has the minister considered making a formal complaint to ASIC over possible breaches of Corporations Law by the company and, in particular, whether there ought to have been a prospectus with respect to the offer made?

Answer:The Hon. T.G. ROBERTS (Minister for Aboriginal Affairs and Reconciliation): It sounds to me like a pirating scheme that needs to be investigated. Bearing in mind that speaking like a pirate was two days ago, I am a little bit late. It is an important question. Scams like these are drawn up and operate generally out of either a Gold Coast address or a Brisbane address, and it is difficult for state authorities to track them down but, with the use of the internet and complementary legislation, efforts are being made to try to keep those scams from reappearing periodically, which is generally what they do. The pressure gets hot, they go to ground and then they appear again. I will refer that important question to the Minister for Consumer Affairs in another place and bring back a reply.

Yes, I followed the rules exactly as instructed. "Amazingly", I have not experienced a month in which I have ended with more money than I started with. When I contacted Nova I was told not to give up as they had every faith in the system. What I can't understand is why they claim to have had 24 months of positive returns and yet when I invest, there is a sudden losing streak ha ha.

Now you'll see that there is one former name, NERANGDENT PTY. LTD. and several changes of details I recieved the first phone call a week or so ago. And when I decline the one of the last two positions they ring back today with still only two positions left. It sounded suspicious when i first heard it. But the second time was a little more convincing, I guess I'm too trusting. Hansard, I would never have guessed. I was initally asked for pay $6500 plus have a trading balance in the TAB account, the second offer was $3500 plus $1000 as the trading balance, with the $3000 coming out of my 'profits'. I've spoken to them on three or four occassions and they are persistant. But it just does not sound for real.
They mentioned that there is a lot of skepiticism about the product, well no wonder. If they are genuine then they should really choose to market there product in a different way that exudes the intergrity they claim to have.

This company should be more transparent if it intends to do legitament business. I didn't look at the booklet they first sent out, I glanced at later after the phone call and realised it was very superfical does not give you anything close to the detail provided by a prospectus registered with ASIC detailling the risks... etc... not even an attempt to mimic it. Something needs to happen and tomorrow I will phone ASIC to find out what the go is. More information needs to be on ASIC or the ACCC's website to show potential victims to stay away from this deal, IF IT REALLY IS NOT FOR REAL. REMEMBER THAT AFTER ALL THAT I HAVE SAID, I HAVE NOT HAD THE NEGATIVE EXPERIENCE MYSELF TO SAY THAT THIS IS NOT LEGIT. However, even when I was given the account to deposit the funds in and the BSB number, they didn't specific what I should put in the description so that they know the money is from me. In short, they may be a registered company, but in my own personal view that is not enough grounds to 'invest' or gamble with them. Much safer returns can be achieved through managed funds from reputable fund managers such as Colonial First State, Bt Investments, Perpetual Investments etc... Tried and true savings and long-term investment will get decent returns.

This is some more specific information I found from FIDO (ASIC) with regards to these types of schemes 'betting' schemes. It appears they need to be a Public company (that is 'Ltd' at the end not 'Pty Ltd'), with a licence to operate this scheme, subject to a few exceptions... (less than 20 members or wholesale clients only)

I know it doesn't work. I became concerned about the secrecy, deception and keeping your sale people in the dark.

So I made a few calls to clients who had bought (this is strictly forbidden by management in case some of the sales people had a conscience). What I found out was devastating to me. Even the clients that had a few wins and had got ahead to start with had experienced long losing streaks and ended up going consistently backwards... Yes, I quit.
For me to sell any product I have to beleive in it. They rely mainly on unscrupulous sales types who have no conscience. For the few that do have a conscience, they definitely don't want you to know anything. We read from a spiel, never ever get to see or run the program, and never see the selections before an event or the results from those selections(except for the fabricated selections and results).

Just to prove I did work there, here a few names of people in management.. Kirsty, Jenny, Scott, Cal, Colin, John (GM).. and if anyone wants more details post a message and I'll give you an email address.

Here's a few quotes for you all to reflect on:

I first dealt with a man called Paul and he seemed extremely genuine and reassuring of the company and the product, then i received a phone call from a woman named clare who claimed Paul's clients had been passed onto her whilst he dealt with personal issues. clare was extremely confident and well trained in sales, she was ridiculously pushy in comparison to Paul and did lead me to think there was something suspicious. I cannot wait to speak to clare again and lead her on to think i am in and give her an incredible serve for the money they have stolen off many people and the deceptive measures they have used to get it!! I once again thank all the people that have rallied against this scum called Nova Investments Solutions and am sure to spread the word!!!!!!!!!

Thanks to the information received via my email address at logic200scam@hotmail.com, I can now reveal some data which conclusively proves that the progam is trash and that Nova are operating a scam.

The publication for Logic 200 as issued by Nova Investment Solutions shows how the program converted an initial $10,000 investment at the beginning of Dec 05 into into a total of $14,995.40 by the end of the month ie a profit of $4,995.40 for the month.

By comparison, I followed the tips exactly as provided by Nova (I was one of those foolish investors) and the fact is that, in December, had I invested $10,000 I would have ended up with $7,129.31 at the end of the month ie a loss of $2,870.69. Not suprisingly, the tips in the brochure are completely different to those that were provided to me by Nova.

What do you have to prove that the selections given by Nova are not exactly as printed in the booklet? For all we know you could be a competitor or just some random punter who never stuck to the program as advised.

Prior to me purchasing the program I also came across the SA case and I followed up on it. Can anyone tell me why the couple didn't proceed? Or why nothing was ever done about it? Why ASIC never shut Nova Investment Solutions down?
I'm not 100% sure - and I'm not going to pretend I do. But I can tell you this much. The finance industry is one of the most governed industries in Australia. If this was a scam and it was brought to the attention of a Member of Parliment then we can safely say that ASIC would have gone through them with a fine tooth comb.
I think that you'll find that nothing eventuated from this case because the couple were punters and instead of following the program blindly - i.e. 5% investments and only betting on the selected horses - they gambled more and on their own choices. This was proven when the couple printed out a statement from their telebet account.

Just because you have a calculator and worked out that Scam rhymed with Cam doesn't give you any kind of credibility.

We have participated in the programme EXACTLY as we were told. Here is an update of results over an eight week period from the 22.4.06 to 10.6.06. Decide for yourself.

16 RACES AND 2 WINS. Nobody, but nobody is going to make any money from those sort of results.

Even if the computer woke up with a headache or had a cold you would think it would do better than 16 RACES AND 2 WINS! Perhaps at a place you might cut even if you were lucky, but we were guaranteed we would make money IF WE WENT FOR A WIN! Using 5% of our working capital.

How can anyone be POSITIVE when we have all been sucked in to a crooked deal. We are just reporting the facts!

Hi Jack. I can't say who I work for but I am involved with gathering information about the dealings of these people. You are right about the websites having almost identical wording. Definitely the same operators and we have proof of that. Further more, information is being gathered about these people, their operations, and their is a trail of info, including accountants, bank accounts, transactions.. etc
I have been handed numerous recorded phone conversations that clients and prospective clients have recorded. This is the information we really require. Proof of the way they market and sell their product and the lies they use.
Anybody who can provide further damning information about these people, please let me know. Also I would encourage Logic Loser to pursue his line.

All your information is mostly correct, except Nova Investment Solutions are seperate from Softholdings and not run by the Softholdings group. Softholdings aren't an Australian company and this makes it difficult to take action. They use a Hong Kong Bank to launder their money and their employees get paid cash that is not taxed. One employee told me that he had worked for them for 7 years and never paid a cent tax. They operate in the UK and in South Africa.
Jamie Pickerings Tomato Technologies is legit so I would leave him out of it unless you want a defamation suit. He has a program that works, provides customer support and is registered on the ASX. Don't get me wrong, he was involved years ago with the shonky ones but now is doing everything above board.

However they are all buddies and socialise together.

Now Nova Investment Solutions is run by another "gang". The big boss is Kevin Robinson who lives Vanuatu. He has family on the Gold Coast, kids, grandkids etc. The GM is John Sherrin whose stepdaughter is Ricky-Lee, Australian Idol finalist.
Some of the company names they have operated under are Austral Rom, Quay Corp, Drayton Corp, Cambridge W/A, Mountbridge, Dow Pacific..

The real solution is for the governement to crack down and pass some serious laws about telemarketing and telesales. This industry is plagued by charlatans who have no scruples. The main problem is that the majority of people who get ripped off are too complacent and don't take action. It seems that there is now some momentum going, keep it going.

Essentially this is organised crime.

I feel sorry for those who have lost hard earned cash to these people. They are very convincing, very evil and its time to shut them down.

When did you start using the program? Were you receiving tips in 2005? I have been ripped off too and I believe we should all share information but what we really need is some people that were getting tips in 2005. We can then compare those figures to the results stats provided by Nova. Nova will not provide any stats for 2006.

Apparently the Dept of Fair Trading Qld is now investigating Nova. We may have some recourse through the Consumer, Tenancy & Trader Tribunal but the more information we can give each other, the more we can strengthen our cases against them.

You have been doing the program for longer than me - I'm interested to know if you have had any profitable months?

2 potential Investors that did not proceed after reading about the scam on the internet and contacting me.
5 investors that have lost money - Investor #1 $7500, Investor #2$3500, Investor #3 $3500, Investor #4 $6500 and Investor #5 $unknown.
1 ex-employee of Nova. I have names and contact details for each but have not divulged them for privacy reasons.

The most useful and damming information was provided by one of the potential investors who sent me the Nova brochure with their so called "results for 2005". I compared this information with the predictions that I was given by Nova during Dec 05 and this is how I established that the Nova "results" bear no resemblance to the predictions provided by Nova - its an absolute fraud. Not surprisingly, Nova claimed a profit of $4,995.40 for Dec 05 whereas the actual results netted a loss of $2,870.69.

I would still like to hear from investors that joined the scam during 2005 and, in particular, I would like details of the tips issued by Nova via the 1902..... confidential number so that I can compare them with the Nova brochure. Not suprisingly, the bank balance is showing a hefty overall $8,084 LOSS with only one month showing a profit.
